Article 1: Purpose
This document purpose is to define the general terms of use of products sold by the GOTO GAMES company located at 3 Avenue Antoine Pinay, Parc d'activités des 4 vents in Hem (59510), registered with the RCS Roubaix-Tourcoing under number 509567681 and VAT number FR 30509567681.
In the absence of special provisions agreed in writing, all orders are subject to these general conditions prevailing on any printed document by the Customer, who acknowledges having read these and accept them without reservation.
However, it is agreed that these do not replace the license agreement to end user, in the case of supplying of software.


Article 2: Order
To order one or more products and following his selection by clicking on the "Buy" tab, the Customer is redirected to the "Store" page summarizing his order. He can thus check the price before VAT, the desired quantity and VAT.
By validating the next step, the Customer will need to specify its location.
Thereafter, the Customer will be required to state his postal address. GOTO GAMES reminds the Customer that he is solely responsible for the information provided. The Customer agrees, therefore, to provide accurate information. GAMES GOTO cannot be held responsible for late or non-delivery, in case of error, voluntary or not, in data submitted by the Customer.
Unless otherwise specified at order date, the Customer may choose the mode of delivery of the product ordered. The mode and delay of delivery of the product will be detailed on order date. Finally, for the order checkout, GOTO GAMES summarizes the order details and offers various payment methods. We recommend the Customer to thoroughly check the information provided. Subsequently and after payment, the Customer will receive a confirmation email to the email address that was provided when ordering. The order validation implies full acceptance of these terms.


Section 3: Financial Terms
The applicable price shall be the one on the day of order taking. The prices shown are excluding VAT, it will be needed to add the current VAT and delivery charges, if any, themselves given the day the order is taken.
Our products and/or subscriptions are payable in cash, or directly online by communication of a of credit card number (via SSL), or by check sent directly to the order of GOTO GAMES, or any other possible payment method at the date of order.


Article 4: Delivery
For software delivery by simply downloading files:
From online ordering of the software and credit verification of the customer's account by GOTO GAMES, GOTO GAMES will immediately and during normal office hours send to the email address provided by the Customer, the corresponding software file(s).
For membership subscription:
From online ordering and credit verification of the customer's account by GOTO GAMES, GOTO GAMES will immediately and during normal office hours activate the subscription for the selected period of time. The Customer will receive an electronic confirmation reminding him of the duration of its subscription.
In case of physical delivery of software or other products:
GOTO GAMES commits itself to deliver the product within the time specified when ordering.
However, GOTO GAMES undertakes to inform the Customer of a possible delay in the order processing.
GOTO GAMES cannot be held responsible for non delivery of goods, in case of erroneous information supplied by the customer.


Article 5: Return Policy
    Section 5.1: Right of withdrawal
If and only if the Customer meets the definition of a consumer and the product is sent by post, the Customer shall then have a period of fourteen (14) days to return the product.
The product must be in perfect condition, in its original packaging and sealed. No return or refund of product will be accepted once the product has been opened.
The GOTO GAMES Company undertakes to refund the Customer as soon as possible, without exceeding 30 days from receipt of the product.
In the event that the product had been sent by email or downloaded file(s), the Customer cannot return the product sold this way and the sale will be considered perfect. The GOTO GAMES Company thereby will not issue any refund.

    Section 5.2: Legal guarantee
The risk of damage, loss or theft of products will be transferred to the buyer upon delivery. It is therefore for the customer to verify the contents of the package upon delivery.
In accordance with the laws in force relating to the contract conformity, we will refund or exchange the products apparently defective or not matching the placed order.
The products will be taken back only if all elements of the product (packaging, instructions ... etc.) have been sent back. To exercise this right, please contact the GOTO GAMES Company by phone, mail or via the contact form online.


Article 6: Cancellation (Case of Funbridge subscriptions types)
The Customer can cancel its Funbridge subscription under the following conditions:
- Monthly subscription by tacit agreement :
For every monthly subscription, Funbridge informs the Customer via e-mail, sent to the e-mail address given during the Account creation, of the upcoming renewal of its subscription for a month. When the Customer decide to cancel the Service, it has the possibility to do it using its Funbridge account or by sending a regular post mail to the GOTO GAMES Company. (See Legal notice). The Customer is informed that the cancellation is taken into account 48 hours later, for technical reasons.
- Limited period subscription :
The Customer has the possibility to choose its commitment period. To this end, the Customer is committed until the end of the subscription. The Customer has the possibility to cancel its subscription, however refund is not permitted except in case of mutual agreement.


Article 7: Industrial - Intellectual Property
The GOTO GAMES Company reminds that all of its products and brand names are protected by enforced intellectual property and industrial rights. Any breach of these provisions may result in criminal liability of the Customer.


Article 8: Privacy
In accordance with Law No. 78-17 of 6 January 1978 relating to data, files and freedoms, the GOTO GAMES Company Customer have a right to access, delete or amend their personal information. They can exercise this right by contacting by mail GOTO GAMES, 3 Avenue Antoine Pinay, Parc d'activité des 4 Vents, 59510 HEM.


Article 9: Severability
In the event that any provision hereof is declared invalid or unenforceable, such provision shall be severed and the remaining portions hereof shall remain in full force and effect.


Article 10: Force Majeure
In case of a force majeure recognized as such by the courts the GOTO GAMES Company cannot be held liable for failure or delay in delivery of software and the buyer cannot claim a possible prejudice.


Article 11: Competent Law and Jurisdiction
Any dispute concerning the interpretation and enforcement of these general Terms shall be subject to French law. The dispute thus raised will be submitted to the competent court.


Article 12: Special conditions: player suspension and / or expulsion
Funbridge reserve its right to block a player access to Funbridge, temporarily or permanently (with membership subscription refund (excluding given months) in the last case) for any conduct contrary to morality or behaviour that would interfere of game running smoothly. Among those behaviours, without being an exhaustive list; cheating, disrespect towards players, slanderous comments toward players and/or Funbridge, abusive and voluntary flooding in the Funbridge forum or any communication support like the «To all chat area»...


Rules concerning the game Funbridge

Account creation
- When creating an account you must supply a nickname without inappropriate connotations (for example: Moron, facist) and distinctive (try to avoid general terms like Funbridge or Moderator), as well as a valid e-mail address.
- In the member profile, only pictures of a member in an appropriate situation, without children, and in a valid format are accepted. Images or pictures displaying more than one person, or with a content that can be considered as choking, are not accepted.
- You must commit yourself to having only one member account.
Any account not respecting these rules will be deleted without prior notice.
- You are the only person responsible for the use of your account and you agree not to disclose your password to anyone. Funbridge is not responsible for the fraudulent use of your account.

Private data
- The information displayed in your profile is visible to the other internet users. You must take care not to input personal data you do not wish to disclose (age, town, work...).
- Funbridge reserves the right to collect data during the creation of an account and hand these data over to the competent authorities (justice court, police, providers) if necessary and in order to identify the internet users who contravene provisions of the law.
- In pursuance of the law n°78-17 of January, 6th 1978 on the IT & Freedom law, you declare being aware that personal data given during your registration are collected and stored in the database of the website.
- In accordance with the law n°78-17 of January, 6th 1978 on the IT & Freedom law, you have the right to consult, modify or suppress any of these personal data appearing on your member profile. Please, contact Funbridge using the Contact page, specifying your request.

Proper behaviour in Funbridge community
- Funbridge reserves the right to suppress any commentary or picture contravening to standards of public decency like offensive, discriminatory or containing insults.
- The Funbridge Team has a free hand to take the decision it estimates necessary (suppression of data, suspension of an account, banishment).
- You are aware of being the only person responsible for your words and your acts on the website and in the software. You acknowledge that Funbridge cannot be hold responsible for the words and acts of its members.
- You commit yourself to use a proper language using the tools made available on our website. Explicit, vulgar, violent or racist expressions are totally prohibited. Text message style writing is not desired.
- You commit yourself to not posting links of inappropriate websites or competitors. You are aware that your responsibility is entirely involved concerning the information you publish on our website. Any threat assessment to the website or one of its users, regardless of the medium, may lead to an expulsion. Therefore you commit yourself to not causing prejudice to our website, our image or any of its users.
- Funbridge reserves itself the right to temporary block access to Funbridge or exclude a player (refunding its subscription (with the exception of months offered) in this last case) in case of inappropriate behavior or behavior which spoils the game. Among these behaviors we consider (without being exhaustive): cheating, lack of respect between players, libelous comments about players and/or Funbridge (rude or insulting posts against the robots, will be treated as against human person), abusive or voluntary flooding on our message board or any other communication medium like the «dialogs»...
